Terms and Conditions 

Promoter

The promoter is Diabetes Federation of Ireland (t/a Diabetes Ireland), 19 Northwood House, Northwood Business Park, Santry, Dublin 9 (CHY 6906) under licence granted by Dublin Metropolitan District Court on 19 July 2017.

Prize

The first prize is one right handed new Skoda Octavia Active valued at €22,500 and not necessarily of the model or colour shown in our illustrations. The prize is exclusive of insurances. The prize is not redeemable for cash or transferable to another person. Diabetes Ireland accepts no responsibility or liability to the winner for any dissatisfaction with the prize. The prize is provided “as is” and Diabetes Ireland makes no representation and gives no warranty in respect of the prize. There is also a number of smaller cash prizes and a sellers prize.

Raffle Draw

Entry to the raffle draw is by means of raffle ticket specially commissioned by Diabetes Ireland. On purchase of a ticket for the raffle draw, all purchasers of tickets are automatically entered. Tickets must be retained as proof of purchase.

Raffle tickets are priced at €5 or a book of 6 tickets for €25. By purchasing a ticket, entrants agree to be bound by these terms and conditions (please retain a copy of these terms and conditions for your reference) and to take part in any publicity relating to the raffle draw, if invited to participate by Diabetes Ireland.

The raffle draw is open to all persons aged 18 or over at the date of the raffle draw who have purchased a Diabetes Ireland draw ticket between 1 September 2017 and 12 November 2017 except those who at any time during the same period are employees of Diabetes Ireland or any member of their respective households.

Winner Selection

The winning ticket will be drawn by at the Diabetes Ireland Annual General Meeting on Sunday 12 November 2017 in front of a live audience.

If the writing on the ticket that is drawn from the drum is illegible, another ticket will be drawn in its place. This will be witnessed by 2 independent people present during the draw.

The decision of Diabetes Ireland, as the promoter, as to the winners and validity of the entry is final and no correspondence will be entered into.

How to Claim

Diabetes Ireland will use reasonable endeavours to contact within (two weeks of the raffle draw), the winner(s) using the contact details supplied upon purchase of the raffle ticket and the name of the winner(s) will be published in Diabetes Ireland magazine and on www.diabetes.ie

Diabetes Ireland, as the promoter, will not enter into correspondence with third parties and will not use alternative contact details to those supplied upon purchase of the raffle ticket.

The winner must provide a valid driving licence and proof of insurance on collection.

If a winner does not claim the first prize of the car or respond by 31 December 2017, the winner waives the right to claim the car prize and the promoter may draw another ticket in the presence of 2 witnesses.

Publicity

Entrants agree and give consent that, if they win, Diabetes Ireland will have the right, without additional payment or permission, to use their name, age, town of residence and likeness for the purposes of announcing the winner of the raffle draw and for related promotional purposes.

Restrictions

Individuals who attempt to circumvent the system running the draw in any way will not be eligible to participate in the raffle draw. If there are reasonable grounds to believe that there has been a breach of these terms and conditions by an entrant, Diabetes Ireland, as the promoter, may in its sole discretion invalidate the relevant entry and disqualify the entrant from the raffle draw.

Right to modify or cancel

Diabetes Ireland reserves the right in its sole discretion to modify, cancel, terminate or temporarily suspend this competition at any time without notification and with no liability to any entrant or any third party.

If the raffle draw is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorised human intervention or any cause that is beyond the promoter’s reasonable control, the promoter reserves the right to substitute the prize for another prize of equal or greater value.

Limitation of Liability

The promoter’s total liability in contract, tort (including with limitation, negligence) or otherwise arising out of or in connection with or in relation to these terms and conditions or arising out or in connection with or in relation to any non-contractual arrangement shall be limited to the amount actually paid or payable by the entrant for the raffle ticket. The limit of the promoter’s liability herein has effect in relation both to any liability expressly provided for under these terms and conditions and to any liability arising by reason of the invalidity or unenforceability of any terms of these terms and conditions.

Governing Law and Jurisdiction

The terms and conditions herein are governed by Irish Law and the parties submit to the exclusive jurisdiction of the Irish Courts.
